Elder Law

Elder law is estate appropriate steps for the protection of your assets in the event you need nursing home, assisted living or other long-term care. It is often referred to as Medicaid planning but it involves much more than that. A person who waits until they obviously need to address elder law issues may discover they waited too long. Taking the right steps now can help you protect your estate and can avoid the time and expense involved in establishing a conservatorship in Probate Court, should you become unable to manage your own affairs at some point. You want an experienced lawyer to help you put together a plan that best fits your unique needs.

At the office of Patrick J. Gibbs, P.C., Attorney at Law, I have more than 35 years of practice experience, the last 20 years focused mainly on estate planning. Elder law issues are often presented by my estate planning clients. I encourage clients to take a comprehensive and integrated approach to elder law matters, carefully considering how asset protection strategies and health care planning fit into an overall estate plan. My emphasis is always on finding efficient and cost-effective solutions that meet your individualized needs.

My Elder Planning Practice

I will help you put together an effective plan to minimize the risk that your assets will be wiped out by the costs of long-term nursing home or other care. I will work with you to take the appropriate steps to maximize the benefits you may recover from Social Security, Medicaid and Medicare. I will also help you put all necessary documents in place to allow others to make decisions that are in your best interests, should you become unable to manage your own affairs. I can help you accomplish these goals with the use of a trust or a power of attorney.

I will integrate your asset protection planning with all other aspects of your estate plan. In the process, I will look at probate and non-probate assets, such as long term care insurance, life insurance and retirement plans, helping you take all legal measures to protect those assets for your heirs. I will prepare all the documents necessary to implement an asset protection plan, including trust documents, and will help you manage the transfer of property into the trust so that you don't unnecessarily incur any risks.
