Wills Attorney in Roswell, GA
Georgia Estate Planning Attorney
Is it time to put a will in place to ensure the orderly distribution of your assets in the event of your death? Not only can a will help you make certain your wishes are followed, but it can also alleviate or minimize the stress on your loved ones when they are grieving your loss. An experienced lawyer can help you create a simple and effective document that clearly conveys your wishes.
At the office of attorney Patrick J. Gibbs, I have more than 40 years of practice experience. Since 1992 I have focused mainly on estate planning and probate matters, including the preparation and execution of wills. In my years in practice, I have been involved in the preparation of more than 2,000 estate plans. I take a comprehensive approach, looking at probate as well as non-probate assets such as life insurance policies or retirement plans. I will work to integrate your planning to accomplish your overall objectives. My emphasis is always on solutions that are cost-effective.

Helping You Draft a Will
I will handle all matters related to the preparation and execution of a last will and testament, which you can use to govern the distribution of your property and identify potential guardians for any minor children. I will take the time to obtain the necessary details as to your financial situation. I will help you understand the different strategies you can employ in a will, including:
• Specific bequests: You identify who will receive specific items of property or allocations of money.
• Residuary bequests: All assets are pooled together and divided according on a percentage basis.
• Testamentary trusts: You name a trustee to protect the estate passing to your children if no parent is living.
My goal when preparing your will is to clearly state your objectives so that there is no confusion among your beneficiaries. I work with you to prepare your estate so it can pass efficiently through the probate process. Your executor will be able to administer it with the least amount of time and expense under the circumstances.
Dying Without a Will
If your loved one has died leaving property and there is no valid will, you may be worried about how assets will be distributed. The State of Georgia has enacted laws to address this contingency. You want an experienced attorney to protect your interests, though, someone who understands the law and the process, who has represented others in similar situations.
At the office of Patrick J. Gibbs, P.C., Attorney at Law, I bring more than 40 years of legal practice experience to people in and around Roswell. Since 1992 I have focused on estate planning and probate matters. I believe in taking a comprehensive approach, looking at all aspects of your situation to help you find solutions that meet your needs in a cost effective way.
When Your Loved One Dies Without a Will
Contrary to popular belief, dying without a will does not mean that the state takes your property. Georgia has enacted statutes, called intestacy laws, that set forth the specific provisions for the distribution of an estate when someone dies without a will. Simply knowing the percentages established by the law won't help you complete the probate process, though. You will still need to have an administrator appointed, and a fiduciary bond (requiring payment of a bond premium) may be required for that administrator.
At my office, I will quickly and efficiently handle all matters when your loved one dies without a will. If you are the spouse, I can get you named as the administrator of the estate and, if necessary, assist you in establishing a conservatorship for any minor children. I will file all necessary documents required by the probate court and will be your advocate in all hearings or proceedings throughout the process. If there are children from a previous marriage, I can also assist you in the protection of your rights and your interest in the estate's property.
